Appealing a Denial of Social Security Disability Benefits

If you have made an application for benefits but had it denied, there is no need to despair, and certainly no need to give up. The SSA has a myriad of rules, regulations, and red tape, and in the process there are any number of reasons why your application may have been denied. A denial is, unfortunately, entirely normal, and should be regarded as simply a setback to be appealed against.

However, in the appeals process it is vitally important that the evidence for your case is thoroughly prepared and well presented to the Administrative Law Judge (ALJ) at your hearing. Success or failure will depend on how well the legal arguments are presented.

What if you appeal is denied?

Even in the event that your appeal is not successful before the ALJ, there is still the third step option of making a further appeal to the Social Security Appeals Council.

The Appeals Council will review your case file, consider the ALJ’s decision to determine whether the evidence had been properly considered, and whether any procedural or legal errors were made that might have affected the ALJ’s ruling. The Appeals Council will also consider any new or additional evidence that you might submit.

Having so reviewed and considered your case, the Appeals Council may then choose to (a) deny your appeal – in which case you can still make a further appeal in a federal district court, (b) return your case to the ALJ for another hearing, or (c) overturn the ALJ’s decision and award you benefits.

While it is entirely possible to represent yourself before the Appeals Council, the statistics show that the vast majority of claimants choosing not to be represented by a Social Security Disability attorney are denied.
